24th JDC Judge Alan Green Indicted

Yesterday the feds indicted 24th JDC Judge Alan Green, accusing him of accepting $20,000 in bribes in return for helping Bail Bonds Unlimited and its principal, Louis Marcotte III. Media outlets reporting on the indictment include the Times-Picayune, ABC News, and the Associated Press.

Fifth Circuit Affirms Dismissal of Union Parish Suit Under Voting Rights Act

Residents of Union Parish brought a suit alleging that a redistricting plan for electing parish police jury members violated the Voting Rights Act. At the close of the case, plaintiffs moved to recuse the district judge, on grounds that his wife was employed as an assistant district attorney in the office that represented the defendants. The district judge declined to recuse and dismissed plaintiffs' suit. Yesterday the Fifth Circuit affirmed. Sensley v. Albritton, No. 03-30866 (5th Cir. Sept. 28, 2004).

Biological Relation Necessary to Support Wrongful-Death or Survival Action

Before his death, a man acknkowledged a child as his child born out of wedlock. After the man's death, DNA tests showed that he was not the child's biological father. Under these facts, the Supreme Court holds that the child is not a child for purposes of wrongful death or survival actions under Civil Code Arts. 2315.1 and 2315.2. Turner v. Busby, No. 03-C-3444 (La. 9/9/04).

Judge Morey Sear Dies Over Weekend

The Times-Picayune reports that Judge Morey Sear has died at age 75. Judge Sear was appointed by President Ford as district judge in the United States District Court for the Eastern District of Louisiana, serving as chief judge from 1992-1999. He presided over the trial that sent reputed crime boss Carlos Marcello to prison.
