Appellate CLE materials

On Minor Wisdom, I've posted some materials from a CLE session I taught this afternoon. It was the appellate hour of the Louisiana State Bar Association's Bridging the Gap program, a two-day seminar designed for newly minted lawyers to "bridge the gap" between law school and professional practice.

LSC censures Judge Elloie

Today the Louisiana Supreme Court censured Judge Charles Elloie of Criminal District Court, Orleans Parish, for granting ex parte motions to expunge criminal records, without notice to the D.A. and without a contradictory hearing. The Court concluded that Judge Elloie's multiple legal errors in granting these expungements "rises to the level of judicial misconduct." Slip op. at 24.

Bujol v. Entergy Servs. opinion on rehearing

On May 25, 2004, we reported on the Louisiana Supreme Court's decision in Bujol v. Entergy Services, Inc., in which the Court reversed a jury verdict against a parent corporation, in a personal-injury and wrongful-death suit arising from injuries to three of the subsidiary's employees. The Court later granted rehearing. Today, the Court released its opinion on rehearing, reaffirming its original opinion.

In its original opinion, the Court applied a de novo standard of appellate review. In its opinion on rehearing, the Court reached the same result under manifest-error review.

Kean Miller triples size of N.O. office

Here's an interesting item from New Orleans CityBusiness:

BATON ROUGE — Baton Rouge-based Kean Miller Hawthorne D’Armond McCowan & Jarman, LLP, has added 12 lawyers to its New Orleans office, formerly from the Admiralty & Maritime and Construction practice areas with Lemle & Kelleher, LLP.

. . .

The new group from Lemle & Kelleher nearly triples the size of Kean Miller’s New Orleans office from 7 attorneys to 19 attorneys. The firm now has 121 total lawyers in Louisiana.
